Terms & Conditions of Sale and Use

1. Acceptance of Terms.
Welcome to yachttoys.co.uk (the "Site"). These Terms and Conditions ("Terms") govern your use of our website and the procurement services offered by Yacht Toys ("we", "us", "our"). By accessing or using any part of the Site, you agree to be bound by these Terms. If you do not agree to all terms, you may not access the Site or use our services.

2. User Accounts and Authority.
To access certain features, you may be required to create an account. You are responsible for maintaining the confidentiality of your account and password. If you are a professional crew member or management company, you warrant that you have the explicit authority to bind the vessel's owner or operating company to these financial and legal obligations.

3. Specialised International Logistics.
Most goods are dispatched from our fulfillment center in the Netherlands. We operate on a DAP (Delivered at Place) basis unless otherwise agreed. As a full IATA Cargo Agent, we handle all documentation and lithium battery formalities. However, the Customer remains the "Importer of Record" and is responsible for local duties, taxes, and ensuring the product meets the regulations of the destination jurisdiction.

4. Product Accuracy and Technical Specifications.
We make every effort to display the colors and images of our products accurately. However, we cannot guarantee your monitor's display will be exact. While we provide expert shoreside consultation regarding lazarette storage and deck weight limits, the final responsibility for ensuring equipment compatibility with the vessel rests solely with the Captain or Owner.

5. Bespoke Branding and Customisation.
Items involving custom printing or embroidery are exempt from standard return policies. Once production has commenced on a customised item, the order cannot be canceled. We are not liable for branding errors resulting from Customer-supplied artwork.

6. Orders, Billing, and Risk of Loss.
We reserve the right to refuse any order. Risk of loss and title for all products pass to you upon our delivery of the goods to the shipping carrier. Payment must be received and cleared in full before our acceptance of an order and subsequent dispatch from the warehouse.

7. Limitation of Liability and Indemnification.
In no case shall Yacht Toys, our directors, or employees be liable for any injury, loss, claim, or any consequential damages of any kind, including lost charter revenue or vessel downtime, arising from your use of any products procured. You agree to indemnify and hold harmless Yacht Toys from any third-party claims arising out of your breach of these Terms or your violation of any international maritime laws.

8. Intellectual Property and Prohibited Use.
All content on this Site is the property of Yacht Toys or its suppliers. You are prohibited from using the Site for any unlawful purpose, to infringe upon our intellectual property, or to transmit malicious code. We reserve the right to terminate your use of the service for violating any prohibited uses.

9. Governing Law.
These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
